5.1 Who controls your information

Enso Design Lab (“ENSO”) is a trading brand of ENSO COLLECTIVE GIFTS TRADING L.L.C. The company is the controller of personal information described in this Privacy Policy, except where another party explains that it acts as an independent controller.

This Policy applies when you visit or use the ENSO website, create an account, communicate with us, subscribe to communications, place or seek to place an order, or otherwise use the Services.

5.2 Information we collect

Depending on your interaction, we may collect:

• identity and contact information, such as name, email, telephone number and billing or delivery address;
• order and transaction information, such as products viewed or ordered, order status, returns, messages, delivery information and payment confirmation;
• account and preference information, if customer accounts or saved preferences are used;
• communications, enquiries, complaints, reviews and information you send to us;
• device, browser, network, cookie and usage information, such as IP address, identifiers, pages viewed, referrals and interactions;
• fraud-prevention, security and compliance information; and
• inferences or audience information created by analytics or advertising services where permitted.

Payment-card details are generally collected directly by authorised payment providers. ENSO may receive limited payment information such as method, status and transaction reference rather than the complete card number.

5.3 Where information comes from

We collect information directly from you; automatically through the website and cookies; from Shopify and other providers that operate the store; from payment, fraud-prevention, analytics, communications and logistics providers; and from partners or public sources where lawful.

5.4 Why we use information and our legal bases

We use personal information to:

• provide the website, respond to enquiries, process payment, accept and fulfil orders, arrange delivery and returns, and administer accounts—because this is necessary to take steps at your request or perform a contract;
• provide support, investigate complaints, prevent fraud, secure the Services, keep business records and improve operations—where applicable law recognises legitimate interests as a legal basis and after balancing those interests against your rights;
• comply with tax, accounting, customs, sanctions, product-safety, consumer, court and regulatory obligations—because processing is required by law;
• send marketing or use non-essential cookies and advertising technologies—where we have consent or another lawful basis permitted in your country; and
• establish, exercise or defend legal claims and protect people, property and rights where necessary.

Where we rely on consent, you may withdraw it at any time without affecting earlier lawful processing. Where EU/EEA or UK law applies, the relevant legal bases include contract, legal obligation, legitimate interests and consent as described above.

5.5 Cookies, analytics and advertising

We use necessary cookies to operate security, checkout, account, language, consent and shopping functions. Where enabled and permitted, we also use analytics and advertising technologies, including services supplied by Shopify and Google Analytics, to understand use of the Services, measure performance and improve or promote ENSO.

Non-essential cookies and similar technologies are controlled through the cookie banner or privacy choices made available for the relevant region. See the Cookie Notice for details. You can withdraw consent or update available choices at any time through Your Privacy Choices on the website. Browser settings may also block cookies, but some Services might then not function correctly.

5.6 When we share information

We disclose only the information reasonably necessary to:

• Shopify, which hosts and supports the store and may act as a processor or independent controller for certain services;
• payment, fraud-prevention and banking providers;
• approved couriers, fulfilment and customs providers;
• website, cloud, security, customer-support, email and communications providers;
• analytics and advertising providers, including Google where enabled and lawfully permitted;
• professional advisers, insurers, auditors and authorities where necessary; and
• a buyer or successor in a genuine corporate transaction, subject to appropriate safeguards.

We may also disclose information when you ask us to, when required by law, or to protect legal rights and safety. Where a provider acts on our instructions, its handling of personal information is subject to the applicable contractual and data-protection requirements.

Depending on applicable law and the technologies enabled, some advertising-related disclosure may be treated as “sale,” “sharing” or targeted advertising even where no money changes hands. Eligible users can opt out through Your Privacy Choices or a recognised Global Privacy Control signal where supported.

5.7 International processing

ENSO is based in the UAE, while Shopify and other providers may process information in other countries. Those countries may have different data-protection laws. We will use the contractual, organisational and technical safeguards required by applicable law. Where EU/EEA or UK law applies, the lawful mechanism may include an adequacy decision, Standard Contractual Clauses, the UK equivalent or another permitted mechanism, depending on the actual transfer and provider.

5.8 Retention

We keep personal information only for as long as reasonably necessary for the purpose collected, including to complete an order, support the customer, maintain security and meet legal, tax, accounting, customs, warranty, dispute and record-keeping duties. Retention is determined by the type of record, the customer relationship, legal requirements, limitation periods, active disputes and the ability to delete or de-identify the information.

Marketing contact information is kept until you unsubscribe or object, plus a limited suppression record so we can honour the request. Cookie and analytics retention follows the relevant tool setting and consent choice. When information is no longer required, we delete, de-identify or securely isolate it unless law requires continued retention.

5.9 Security

We use reasonable technical and organisational measures appropriate to the nature and risk of the information. No system is completely secure. Do not send full payment-card data, passwords or identity documents through ordinary email unless we have specifically provided a secure method.

If a personal-data breach presents a risk requiring notice, we will take the steps and notify affected individuals or competent authorities as required by applicable law.

5.10 Your rights and choices

Depending on applicable law, you may have rights to receive information about processing; access personal information; obtain a copy; correct inaccurate information; delete information; restrict or object to processing; transfer information; withdraw consent; object to direct marketing; opt out of sale, sharing or targeted advertising; and challenge certain automated decisions.

To exercise a right, email flow@ensodesignlab.com or use an available privacy-choice tool. We may request proportionate information to verify identity and authority. We will not discriminate against you for exercising a right. A lawful exception may apply, and we will explain a refusal where required.

EU/EEA and UK residents may also complain to their local data-protection supervisory authority. UAE data subjects may complain to the competent UAE authority in accordance with the UAE Personal Data Protection Law. Eligible US residents may appeal or use an authorised agent where applicable state law provides that right.

5.11 Marketing

You can unsubscribe from promotional email using the link in the message or by contacting us. Opting out of marketing does not stop necessary messages about an enquiry, order, return, account, security or policy change.

5.12 Children

The Services are not directed to children and we do not knowingly collect personal information from a child who cannot lawfully provide it. A parent or guardian who believes a child supplied information should contact us.

5.13 Automated decisions

We may use automated fraud or security tools to flag a transaction for review. We do not intend to make a solely automated decision that produces a legal or similarly significant effect unless permitted by law and accompanied by required safeguards. Contact us if you wish to request human review where applicable.

5.14 Changes and contact

We may update this Policy to reflect legal, technical or operational changes. The effective date will be updated and material notice will be provided where required.

Cookie Notice

6.1 What cookies are

Cookies and similar technologies store or access information on a browser or device. They can be placed by ENSO, Shopify or another provider whose service is used on the website.

6.2 Categories

• Required: security, network management, consent choices, checkout, cart, accounts, language and core operation. These cannot generally be disabled through the ENSO banner because the Services may not work without them.
• Personalisation: remembers permitted choices and adapts functionality.
• Analytics: helps measure visits, interactions, performance and errors. Providers may include Shopify and Google Analytics where enabled.
• Marketing: measures campaigns or supports interest-based advertising where enabled and permitted.

6.3 Your choice

Where consent is required, ENSO uses Shopify’s automated regional privacy settings to request it. The banner allows you to accept, decline or manage the available categories. Shopify records and applies that choice to Shopify-controlled technologies and compatible pixels; strictly necessary processing remains available so the Services can function. A service that is not controlled by Shopify must be configured separately to respect the applicable choice before it is enabled.

You may later change the available choices through Shopify’s cookie-preferences control where it is displayed, or contact flow@ensodesignlab.com for assistance. Withdrawing consent does not affect processing that was lawful before withdrawal. The current categories, providers, purposes and durations displayed through Shopify’s privacy interface supplement this Notice and may change when the store’s apps or services change.

5.2 البيانات الشخصية التي نجمعها

يجمع مزودو الدفع المعتمدون عادةً بيانات بطاقة الدفع مباشرة. وقد تتلقى ENSO بيانات محدودة مثل وسيلة الدفع وحالته ومرجع المعاملة بدلاً من رقم البطاقة الكامل.

5.3 مصادر البيانات

نجمع البيانات مباشرة من صاحبها؛ وتلقائياً عبر الموقع وملفات تعريف الارتباط؛ ومن Shopify وغيره من مقدمي خدمات تشغيل المتجر؛ ومن مزودي الدفع ومنع الاحتيال والتحليلات والاتصالات والخدمات اللوجستية؛ ومن الشركاء أو المصادر العامة حيث يكون ذلك مشروعاً.

5.4 أغراض الاستخدام والأسس القانونية

نستخدم البيانات الشخصية من أجل:

• توفير الموقع والرد على الاستفسارات ومعالجة الدفع وقبول الطلبات وتنفيذها وترتيب التوصيل والإرجاع وإدارة الحسابات، لضرورة اتخاذ خطوات بناء على طلب صاحب البيانات أو تنفيذ العقد؛
• تقديم الدعم والتحقيق في الشكاوى ومنع الاحتيال وتأمين الخدمات والاحتفاظ بسجلات العمل وتحسين التشغيل، حيث يعترف القانون الواجب التطبيق بالمصلحة المشروعة كأساس للمعالجة وبعد موازنة تلك المصالح مع حقوق صاحب البيانات؛
• الامتثال لالتزامات الضرائب والمحاسبة والجمارك والعقوبات وسلامة المنتجات وحماية المستهلك وأوامر المحاكم والجهات التنظيمية، لوجوب المعالجة قانوناً؛
• إرسال التسويق أو استخدام ملفات تعريف الارتباط غير الضرورية وتقنيات الإعلان، حيث تتوافر الموافقة أو أساس قانوني آخر يسمح به قانون دولة صاحب البيانات؛ و
• إثبات المطالبات القانونية أو ممارستها أو الدفاع عنها وحماية الأشخاص والممتلكات والحقوق عند الضرورة.

وعند الاعتماد على الموافقة، يجوز سحبها في أي وقت دون أن يؤثر ذلك في مشروعية المعالجة السابقة. وحيث ينطبق قانون الاتحاد الأوروبي أو المنطقة الاقتصادية الأوروبية أو المملكة المتحدة، تشمل الأسس القانونية العقد والالتزام القانوني والمصلحة المشروعة والموافقة على النحو المبين أعلاه.

5.5 ملفات تعريف الارتباط والتحليلات والإعلان

نستخدم ملفات ضرورية لتشغيل الأمن والشبكة وخيارات الموافقة والدفع والسلة والحساب واللغة والوظائف الأساسية. وحيث تكون مفعلة ومسموحاً بها، نستخدم أيضاً تقنيات التحليل والإعلان، ومنها خدمات Shopify وGoogle Analytics، لفهم استخدام الخدمات وقياس الأداء وتحسين ENSO أو الترويج لها.

تخضع الملفات والتقنيات غير الضرورية لشريط ملفات تعريف الارتباط أو خيارات الخصوصية المتاحة في المنطقة المعنية. ويرجى الرجوع إلى إشعار ملفات تعريف الارتباط. ويمكن سحب الموافقة أو تحديث الخيارات في أي وقت عبر Your Privacy Choices في الموقع. كما يمكن لإعدادات المتصفح حجب الملفات، لكن بعض الخدمات قد لا تعمل عندئذ بصورة صحيحة.

5.6 الإفصاح عن البيانات الشخصية

لا نفصح إلا عن البيانات اللازمة بصورة معقولة إلى:

• Shopify الذي يستضيف المتجر ويدعمه وقد يتصرف كمعالج أو متحكم مستقل في خدمات معينة؛
• مزودي خدمات الدفع ومنع الاحتيال والخدمات المصرفية؛
• شركات التوصيل والتنفيذ والجمارك المعتمدة؛
• مزودي خدمات الموقع والحوسبة السحابية والأمن ودعم العملاء والبريد الإلكتروني والاتصالات؛
• مزودي التحليلات والإعلان، بما فيهم Google عندما تكون الخدمة مفعلة ومسموحاً بها قانوناً؛
• المستشارين المهنيين وشركات التأمين والمدققين والجهات المختصة عند الضرورة؛ و
• مشترٍ أو خلف في معاملة مؤسسية حقيقية مع ضمانات مناسبة.

كما يجوز الإفصاح بناءً على طلب صاحب البيانات أو بأمر القانون أو لحماية الحقوق والسلامة. وحيث يعمل مقدم الخدمة بناءً على تعليماتنا، تخضع معالجته للبيانات الشخصية للمتطلبات التعاقدية ومتطلبات حماية البيانات الواجبة التطبيق.

وبحسب القانون والتقنيات المفعلة، قد يعد بعض الإفصاح الإعلاني «بيعاً» أو «مشاركة» أو إعلاناً موجهاً حتى من دون مقابل مالي. ويمكن للمستخدم المؤهل الانسحاب عبر Your Privacy Choices أو إشارة Global Privacy Control المعترف بها عند دعمها.

5.7 معالجة البيانات الشخصية ونقلها عبر الحدود

يقع مقر ENSO في دولة الإمارات، بينما قد يعالج Shopify أو غيره البيانات الشخصية في دول أخرى ذات قوانين مختلفة. وسنستخدم الضمانات التعاقدية والتنظيمية والتقنية التي يوجبها القانون. وحيث ينطبق قانون الاتحاد الأوروبي أو المنطقة الاقتصادية الأوروبية أو المملكة المتحدة، قد تكون الآلية القانونية قرار كفاية أو الشروط التعاقدية القياسية أو ما يعادلها في المملكة المتحدة أو آلية مسموحاً بها أخرى، بحسب عملية النقل والمزود الفعليين.

5.8 مدة الاحتفاظ

لا نحتفظ بالبيانات الشخصية إلا للمدة اللازمة بصورة معقولة للغرض الذي جُمعت من أجله، بما في ذلك إتمام الطلب ودعم العميل والمحافظة على الأمن والوفاء بالتزامات القانون والضرائب والمحاسبة والجمارك والضمان والمنازعات وحفظ السجلات. ويتحدد الاحتفاظ بحسب نوع السجل وعلاقة العميل والمتطلبات القانونية ومدد التقادم والمنازعات القائمة وإمكان حذف البيانات أو إخفاء هويتها.

تُحفظ بيانات الاتصال التسويقي حتى إلغاء الاشتراك أو الاعتراض، مع سجل محدود لمنع إعادة الإرسال واحترام الطلب. وتتبع مدة ملفات تعريف الارتباط والتحليلات إعداد الأداة وخيار الموافقة. وعند انتهاء الحاجة، نحذف البيانات أو نخفي هويتها أو نعزلها بصورة آمنة، ما لم يوجب القانون الاحتفاظ بها.

5.9 الأمن

نطبق تدابير تقنية وتنظيمية معقولة تتناسب مع طبيعة البيانات ومخاطرها، لكن لا يوجد نظام آمن تماماً. فلا ترسل بيانات بطاقة كاملة أو كلمة مرور أو وثيقة هوية بالبريد الإلكتروني العادي إلا إذا وفرنا وسيلة آمنة خصيصاً لذلك.

وعند وقوع خرق للبيانات الشخصية ينشأ عنه خطر يوجب الإخطار، نتخذ الخطوات ونخطر أصحاب البيانات أو الجهات المختصة بحسب القانون.

5.10 الحقوق والخيارات

بحسب القانون، قد تشمل الحقوق الحصول على معلومات عن المعالجة، والوصول إلى البيانات ونسخة منها، وتصحيح البيانات غير الدقيقة، والحذف، وتقييد المعالجة أو الاعتراض عليها، ونقل البيانات، وسحب الموافقة، والاعتراض على التسويق المباشر، والانسحاب من البيع أو المشاركة أو الإعلان الموجه، والاعتراض على بعض القرارات الناتجة عن المعالجة المؤتمتة.

لممارسة حق، يرجى مراسلة flow@ensodesignlab.com أو استخدام أداة الخصوصية المتاحة. وقد نطلب بيانات متناسبة للتحقق من الهوية والصفة. ولن نميز ضد صاحب البيانات بسبب ممارسة حق. وقد يسري استثناء قانوني، وسنوضح الرفض حيث يوجب القانون.

ويجوز للمقيم في الاتحاد الأوروبي أو المنطقة الاقتصادية الأوروبية أو المملكة المتحدة تقديم شكوى إلى جهة حماية البيانات المحلية. ويجوز لصاحب البيانات في دولة الإمارات تقديم شكوى إلى الجهة الإماراتية المختصة وفق قانون حماية البيانات الشخصية. ويجوز للمقيم المؤهل في الولايات المتحدة تقديم تظلم أو تعيين وكيل حيث يمنح قانون الولاية ذلك الحق.

5.11 التسويق

يمكن إلغاء الاشتراك في البريد الترويجي عبر الرابط الموجود في الرسالة أو بالتواصل معنا. ولا يمنع الانسحاب من التسويق الرسائل الضرورية بشأن استفسار أو طلب أو إرجاع أو حساب أو أمن أو تغيير في سياسة.

5.12 الأطفال

الخدمات غير موجهة إلى الأطفال، ولا نجمع عمداً بيانات شخصية لطفل لا يستطيع قانوناً تقديمها. وعلى الوالد أو الوصي الذي يعتقد أن طفلاً قدم بيانات أن يتواصل معنا.

5.13 القرارات الناتجة عن المعالجة المؤتمتة

يجوز استخدام أدوات آلية لمكافحة الاحتيال أو الأمن من أجل إحالة معاملة للمراجعة. ولا نقصد اتخاذ قرار آلي بحت يرتب أثراً قانونياً أو مماثلاً جوهرياً إلا إذا سمح القانون ووفرت الضمانات المطلوبة. ويمكن طلب مراجعة بشرية حيث ينطبق ذلك.

5.14 التعديلات والاتصال

يجوز تحديث هذه السياسة لتعكس تغيراً قانونياً أو تقنياً أو تشغيلياً. وسيُحدّث تاريخ النفاذ، وسنقدم إشعاراً بالتغييرات الجوهرية متى كان ذلك مطلوباً.

إشعار ملفات تعريف الارتباط

6.1 ماهية ملفات تعريف الارتباط

ملفات تعريف الارتباط والتقنيات المماثلة تخزن معلومات في المتصفح أو الجهاز أو تصل إليها، وقد تضعها ENSO أو Shopify أو مزود آخر لخدمة مستخدمة في الموقع.

6.2 الفئات

• الضرورية: للأمن وإدارة الشبكة وخيارات الموافقة والدفع والسلة والحسابات واللغة والتشغيل الأساسي. ولا يمكن عادةً تعطيلها عبر شريط ENSO لأن الخدمات قد لا تعمل من دونها.
• التخصيص: لتذكر الخيارات المسموح بها وتكييف الوظائف.
• التحليلات: لقياس الزيارات والتفاعلات والأداء والأخطاء، وقد يشمل مزودوها Shopify وGoogle Analytics حيث تكون مفعلة.
• التسويق: لقياس الحملات أو دعم الإعلان القائم على الاهتمامات حيث يكون مفعلاً ومسموحاً به.

6.3 اختيار المستخدم

حيث تجب الموافقة، تستخدم ENSO إعدادات الخصوصية الإقليمية الآلية في Shopify لطلبها. ويتيح الشريط قبول الفئات المتاحة أو رفضها أو إدارتها. ويسجل Shopify هذا الاختيار ويطبقه على التقنيات التي يتحكم بها ووحدات التتبع المتوافقة؛ وتظل المعالجة الضرورية متاحة لكي تعمل الخدمات. ويجب إعداد أي خدمة لا يتحكم بها Shopify بصورة منفصلة بحيث تحترم الاختيار الواجب التطبيق قبل تفعيلها.

يمكن تغيير الخيارات المتاحة لاحقاً عبر أداة تفضيلات ملفات تعريف الارتباط في Shopify حيث تكون ظاهرة، أو التواصل مع flow@ensodesignlab.com للمساعدة. ولا يؤثر سحب الموافقة في معالجة كانت مشروعة قبل السحب. وتكمّل هذا الإشعار الفئات والمزودون والأغراض والمدد الحالية المعروضة في واجهة خصوصية Shopify، وقد تتغير عند تغيير تطبيقات المتجر أو خدماته.
