Overview
These Terms of Service (“Terms”) govern your access to and use of our website and online store (the “Services”). By using the Services you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Access & account
You must be the age of majority in your jurisdiction (18+ in most countries) or have consent of a parent/legal guardian. Provide accurate, current and complete information and safeguard your credentials. Account access is personal and non-transferable.
Products & content accuracy
We aim for accuracy, but colors/appearance may vary by device and settings. Descriptions, availability and pricing may change without notice. We may limit quantities or discontinue items at our discretion.
Orders
When you place an order, you make an offer to purchase. We may accept or decline at our discretion. Acceptance occurs after successful payment and our confirmation. Review carefully before submitting; cancellations may be unavailable after acceptance. Purchases are subject to our Refund & Returns Policy.
Personal use only / no resale. You confirm purchases are for personal/household use, not for commercial resale, diversion or re-export. You will comply with applicable export-control, sanctions and import laws and bear any duties and import taxes.
Prices & billing
Prices/promotions may change without notice. The price charged is the price in effect at order time and appears in your confirmation. UAE prices are shown VAT-inclusive where applicable. Unless stated otherwise, prices exclude shipping, handling, customs and import charges. You authorize charges to the original payment method for the order total (including applicable taxes/fees).
Shipping & delivery
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs or events beyond our control. Title and risk of loss pass to you when the order is handed to the carrier. See our Shipping Policy.
Intellectual property
The Services and all related content (trademarks, designs, text, images, video, audio, layout) are owned by Enso Design Lab or our licensors and protected by law. Use is limited to personal, non-commercial purposes. No license is granted except as expressly stated. Unauthorized use is prohibited.
Third-party services (incl. Shopify)
Our store is powered by Shopify and may link to or rely on third-party tools/services. Such tools/services are provided “as is” and are subject to their own terms and privacy policies. All purchases are between you and Enso Design Lab.
Privacy
Personal information is processed in accordance with our Privacy Policy.
Feedback
If you submit ideas, suggestions, reviews or other content (“Feedback”), you grant Enso Design Lab a non-exclusive, worldwide, royalty-free license to use and display such Feedback for operating and improving the Services (in compliance with applicable law). You represent you have the necessary rights and that your Feedback complies with these Terms.
Errors & corrections
Information on the Services may contain errors or omissions. We may correct errors and update/cancel orders based on inaccurate information at any time, without prior notice.
Prohibited uses
- Unlawful, infringing, abusive, defamatory or deceptive activity
- Uploading malware or attempting to compromise security
- Scraping, automated data extraction, or circumventing technical measures
- Any activity that harms Enso Design Lab, service providers or users
Termination
We may suspend or terminate the Services or your access at any time. You remain liable for charges incurred up to the termination date. Sections intended to survive (IP, Feedback, Disclaimers, Liability, Indemnification, Severability, Governing Law) survive termination.
Disclaimer of warranties
Except as expressly stated, the Services and all products are provided “as is” and “as available”, without warranties of any kind, whether express or implied (including merchantability, fitness for a particular purpose, title and non-infringement). We do not warrant uninterrupted, timely, secure or error-free operation. Statutory rights that cannot be disclaimed remain unaffected.
Limitation of liability
To the maximum extent permitted by law, Enso Design Lab (including affiliates, officers, employees, agents, contractors, service providers and licensors) shall not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, savings, data or replacement costs, arising from or related to your use of the Services or products. In all events, our aggregate liability for any claim shall not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations; statutory rights remain unaffected.
Indemnification
You agree to indemnify and hold harmless Enso Design Lab and our affiliates, officers, directors, employees, agents, contractors, licensors and service providers from claims, losses, liabilities, damages and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.
Severability
If any provision is held unlawful, void or unenforceable, the remaining provisions remain in full force and effect.
Waiver; entire agreement
Our failure to enforce any right is not a waiver. These Terms together with posted policies (including Privacy and Refund) constitute the entire agreement.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without consent.
Governing law & jurisdiction
These Terms and any disputes arising out of or relating to the Services are governed by the laws of the United Arab Emirates. You and Enso Design Lab agree to the non-exclusive jurisdiction of the Dubai Courts.
Changes to Terms
We may update these Terms by posting changes here. Material changes will be notified as required by law. Continued use after changes take effect constitutes acceptance.
